Statement of Disclosure: Disclosure will be made on the day of the program regarding any interest or affiliation a speaker may have with a supporting organization.

At the completion of this activity, the participant will be able to:

- list changes which took effect under the HIPAA HiTech Act and the expanded responsibility pharmacists have to protect patient privacy, and the corresponding duty to confirm the legitimacy of the CS prescription prior to dispensing;
- identify "Red Flags" as a means of testing the validity of a controlled prescription and as viewed by the Drug Enforcement Administration pertaining to potential enforcement action against pharmacists and pharmacies;
- identify the role of HHS Office of Inspector General in the oversight of health care providers in prescription and durable medical supplies billing activity for Medicare and Medicaid patients and review recent OIG actions taken against health care providers;
- define the types of behavior in a pharmacy which can result in criminal charges based on deliberate ignorance and willful blindness including charging the pharmacist of a conspiracy with less than legitimate parties involved in the distribution of controlled drugs;
- describe the value of the Patient Monitoring Program database and the need for regular review of such for your pharmacy patients;
- examine the value of checking the NYS Patient Monitoring Program and ways to keep illegal patients who doctor shop out of your respective pharmacy;
- state the distinctions between using the services of a Pharmacy Service Administrative Organization and self-directed PBM negotiations;
- identify key audit issues raised by PBM's;
- identify the distinction between audit overpayments which are civil in nature and audit overpayments which are criminal in nature;
- state the importance of monthly checking the exclusion list for excluded individuals and providers which are issued by HHS Office of Inspector General and the NYS Office of Medicaid Inspector General excluded provider lists.
